Terms & Conditions

By and through the access and/or utilization of this Website, the User shall be deemed to have granted their irrevocable acceptance and express agreement to be legally bound by all stipulations, covenants, and guidelines set forth herein. If the user dissent with the entirety of the conditions articulated here, the User is mandated to immediately cease all access to this Website. 

 

The Packaging World expressly reserves the sole and exclusive right, unilaterally and without limitation, to amend, revise, supplement, or otherwise modify these Terms and Conditions at any juncture without requirement of prior written or constructive notice to the User. Such amended Terms and Conditions shall be duly posted upon this webpage and shall take immediate and full force and effect upon the date of said posting. Continued access subsequent to such posting shall constitute the User’s binding affirmation of the revised terms.

Section 1: Intellectual Property and Site Usage

The entirety of the data, materials, and content comprising this Website, including, but not limited to, all textual content, digital media, graphical elements, imagery, visual illustrations, original design schemas, source code, user interface architecture, navigational assets (inclusive of maps and icons), and all other components, collectively defined as “Website Intellectual Property” are and shall remain the exclusive and proprietary property of The Packaging World. Also, all listed prices across the Website are exclusively denominated in USD.    

 

Unauthorized use, reproduction, or dissemination of the Website is expressly prohibited. No individual, corporation, or other legal entity is permitted, under any circumstances, to copy, duplicate, replicate, store, transmit, re-publish, alter, modify, or otherwise exploit the Website in any medium, form, or manner whatsoever, without the acquisition of explicit, prior written consent or an express written license granted by an authorized officer of The Packaging World. Any violation of this clause shall constitute a material breach of these Terms and may result in immediate legal action and the pursuit of all available remedies under applicable law. 

Section 2: Disclaimers on User Generated Data

The Packaging World hereby and unequivocally disclaims all liability and responsibility for any data, content, information, or material submitted, uploaded, or otherwise posted by its clients, users, or any third party (hereinafter, “User-Generated Content” or “UGC”). 

 

The Company shall not be held liable or accountable for any claims, actions, or demands pertaining to the accuracy, completeness, veracity, or integrity of said UGC. Furthermore, the Company shall bear no liability for the presence of any UGC on its platform that any User may deem objectionable, indecent, offensive, defamatory, or otherwise inappropriate. 

 

The Packaging World reserves the sole and exclusive right, at its absolute discretion, to review, monitor, remove, delete, modify, or retain any UGC without prior notification and without incurring any liability for such action or inaction. In full compliance with all prevailing legal and regulatory mandates, the Company shall fully cooperate with law enforcement agencies and governmental authorities (hereinafter, “Mandated Disclosure”) should disclosure of user-submitted data or UGC be legally compelled for the purpose of commencing or defending legal action. 

Section 3: Legal Capacity for Order Placement 

By providing and submitting personal, financial, or business details necessary for the processing and fulfillment of a purchase order (hereinafter, “Order Information”), the User grants explicit consent to The Packaging World to utilize such Order Information exclusively for the purpose of effectuating the requested transaction and subsequent fulfillment. 

 

The submission of a formal purchase order constitutes a binding affirmation and warranty by the User that they possess the requisite legal right, authority, and capacity to enter into such binding agreements and execute the transaction contemplated therein. 

The Packaging World reserves the absolute right to review and authorize the execution of any submitted order, subsequent to the time of submission. It is the sole responsibility of the User to ensure that they satisfy all legal requirements and possess the necessary legal capacity required to contractually enter into and binding commercial transactions.  

If the commencement of physical production for a confirmed order is delayed for a period exceeding 15 days from the order acceptance date and where said delay is not solely attributable to The Packaging World, the Company reserves the right of re-quotation.  

The client’s continued pursuit of the order after the issuance of the new quotation shall be construed as absolute acceptance of the revised financial terms. Failure to accept the revised terms may result in the order being deemed cancelled. 

Section 4: Artwork and Quality Assurance

All submitted artwork files must conform, without exception, to the following preferable   technical specifications: (a) the file must be rendered in its final print-ready format; (b) the color profile must be exclusively in CMYK color mode; and (c) the image resolution must be, at a minimum, three hundred (300) dots per inch (dpi). The Customer shall take full liability for any resultant printing defects—including, but not limited to, graphic distortion, pixilation, color variance, or lack of sharpness—attributable to the Customer’s failure to adhere strictly to the minimum resolution and CMYK format requirements outlined herein. 

The Customer retains sole and absolute responsibility for the ultimate correctness of the final artwork and chosen color scheme. Moreover, any resulting delay in the production timeline due to the late submission of this final design and color approval shall be borne exclusively by the Customer; the official commencement of the stated turnaround time is defined as the time after approval of the final design. 

A mandatory precondition for the transition of any custom order into the manufacturing pipeline requires the customer’s explicit, formal electronic assent to the final pre-press proof. Upon receipt of approval, the order is deemed irrevocably finalized and instantly enters the manufacturing queue. Subsequently, no further modifications, alterations, or amendments shall be entertained or permitted.  

Customers acknowledge that slight color variations may occur due to the necessary conversion from RGB or Pantone color systems to CMYK printing. Furthermore, post-press finishing processes, such as lamination, may subtly impact on the final appearance and color of the printed product. The customer accepts full liability for any such color variations, and The Packaging World disclaims all liability related to these color shifts. While our team strives to achieve the closest match, we cannot guarantee exact color density or reproduction accuracy. The precision of the final color depends on the limitations of the printing process. 

Section 5: Mode of Payment and Order Cancellation 

Every financial remittance for goods and services shall be denominated in the agreed-upon regional currency specified at the point of transaction. The commencement of manufacturing operations upon any custom order is strictly contingent upon the verified receipt of payment in full (Paid-in-Full status) without limitation.  

The window for order cancellation is strictly limited to a period of four (4) hours following the approval of the final design. However, a cancellation fee will be charged, which shall be calculated as the greater of the following two amounts: (a) 20% of the total gross order value, or (b) the actual documented design and labor costs accrued by The Packaging World up to the precise moment of cancellation. This calculated fee shall be deducted from any resultant refund remitted to the Customer. 

It is the company’s policy to apply sales tax and any other relevant charges to all clients and transactions, in compliance with prevailing regional regulations. The Packaging World reserves the unequivocal right to immediately and unilaterally revise any previously accepted quotation or contractual pricing structure due to a change in tariffs, duties, levies, taxes, or other statutory charges imposed by any competent local, regional, or national governmental or regulatory authority.

Section 6: Quantity Variance

The Packaging World may, at its sole and unfettered discretion, provide a nominal quantity of units more than the volume specified in the Purchase Order (“Overruns”) at no additional charge to the Customer. Such Overruns are non-contractual and non-obligatory. In the event of an Under-Shipment (a final delivered quantity less than the ordered volume), the Customer’s exclusive remedy shall be a proportionate refund of the unit price for the deficit quantity.
